Trailer Rental Terms & Conditions

1. Definitions and Preamble

1.1. "PK IT Trading", "We", or "The Owner" refers to PK IT Trading (Pty) Ltd, registration number 2021/847291/07, operating from Telkom Park, J Section, Botshabelo, Free State, 9381.

1.2. "The Hirer" refers to the person, partnership, or corporate entity who signs the digital rental agreement or enters into a booking transaction for the hire of any trailer or equipment.

1.3. "The Trailer" refers to the specific trailer, accessories, spare wheel, jockey wheel, electrical connector, and tie-down equipment described in the signed rental schedule.

2. FICA Verification and Driver Qualifications

2.1. In compliance with insurance conditions and the National Road Traffic Act No. 93 of 1996, the Hirer must provide a valid South African Driver's Licence (Code B for unbraked trailers under 750kg GVM; Code EB, C1, or EC for braked trailers over 750kg GVM), along with an official South African ID or Passport, and Proof of Residential Address.

2.2. Only drivers who have been vetted and registered in the Rental Agreement are permitted to tow the Trailer.

3. Condition Handover and Inspection Checklist

3.1. Prior to departure, a joint Digital Handover Inspection will be conducted by PK IT Trading depot staff and the Hirer. The condition of tyres, lights, coupler, safety chains, and accessories will be recorded.

3.2. By signing the digital inspection, the Hirer acknowledges that the Trailer was received in sound roadworthy condition without defects other than those recorded in the inspection report.

4. Hirer Obligations and Safe Towing

4.1. The Hirer shall NOT overload the trailer beyond its rated Gross Vehicle Mass (GVM) or payload capacity as marked on the trailer data plate.

4.2. The Hirer must ensure that cargo is securely lashed and evenly distributed with appropriate nose weight (typically 50kg–75kg on the tow ball).

4.3. The Hirer shall NOT take the trailer outside the borders of the Republic of South Africa unless a formal Cross-Border Letter of Authority has been issued in writing by PK IT Trading.

5. Security Deposits and Settlement

5.1. A refundable security deposit is payable prior to release of the Trailer.

5.2. Upon return, the trailer will undergo a return inspection. If the trailer is returned in clean, undamaged condition, the deposit will be refunded in full within 24 to 48 hours.

5.3. Deductions may be made against the security deposit for:

• Damage to the body, lights, jockey wheel, or wiring plug;
• Punctures or tyre damage requiring replacement;
• Cleaning fees if the trailer is returned heavily soiled (livestock, mud, construction debris);
• Unauthorised late returns (billed at R100 per hour commenced);
• Unpaid SANRAL e-tolls or traffic citations incurred during the rental.

6. Cancellation and Refund Policy

6.1. Cancellations made more than 24 hours prior to the scheduled pickup time qualify for a 100% full refund.

6.2. Cancellations made less than 24 hours prior to pickup are subject to a nominal R100 administrative cancellation fee to cover reserved yard staging.

7. Consumer Protection Act (CPA) Notice

7.1. In terms of Section 49 of the Consumer Protection Act, your attention is drawn to clauses limiting liability. While PK IT Trading maintains its fleet to strict commercial roadworthy standards, the Hirer remains responsible for the safe and lawful operation of the vehicle-trailer combination on public roads.
